By booking any walk or experience through theplanetwonk.com, you agree to the following Terms & Conditions and Liability Disclaimer. Please read them carefully before placing a booking request.


1. ABOUT THESE TERMS

1.1 These Terms & Conditions and Liability Disclaimer (“Terms”) constitute a legally binding agreement between Planetwonk LLC, a limited liability company registered in the State of Wyoming, United States (“Planetwonk”, “the Company”, “we”, “us”), and any individual (“Participant”, “you”) who browses, submits a booking request, completes a booking, makes payment, or participates in any walk or experience offered through theplanetwonk.com.

1.2 By ticking the acceptance checkbox at checkout, submitting a booking request, or participating in any walk or experience, you confirm that you have read, understood, and agreed to these Terms in their entirety. If you do not agree, you must not place a booking or participate.

1.3 These Terms apply to every booking made through theplanetwonk.com, regardless of the country in which the walk or experience takes place.


2. ABOUT PLANETWONK

2.1 Planetwonk LLC is a limited liability company registered in the State of Wyoming, United States. It operates a travel experiences platform and booking service through theplanetwonk.com.

2.2 Planetwonk designs, markets, and coordinates walks and social experiences in cities across different countries, delivered through independent local hosts.

2.3 Planetwonk does not hold itself out as a travel agent, tour operator, transportation provider, or accommodation provider.


3. HOSTS AND INDEPENDENT CONTRACTORS

3.1 All walks and experiences listed on theplanetwonk.com are led by independent contractors (“Hosts”). Hosts are not employees, workers, agents, or representatives of Planetwonk LLC. No employment, agency, or partnership relationship exists between Planetwonk and any Host.

3.2 Each Host is solely and personally responsible for the delivery, conduct, and safety management of the specific walk or experience they lead.

3.3 Planetwonk does not supervise, direct, or control Hosts during the course of any walk or experience. Planetwonk is not responsible for any act, omission, statement, negligence, or misconduct of any Host.

3.4 Any claim arising from the conduct of a Host during a walk or experience must be directed to that Host personally and not to Planetwonk.


4. BOOKING REQUESTS

4.1 All bookings submitted through theplanetwonk.com are requests only and do not constitute a confirmed booking or a binding contract until Planetwonk expressly confirms acceptance.

4.2 A booking is confirmed only when Planetwonk sends written confirmation to the Participant by email or other written communication stating that the booking has been accepted.

4.3 Planetwonk reserves the right to accept or decline any booking request at its sole discretion, without obligation to provide reasons.

4.4 Planetwonk reserves the right to impose participant limits, age restrictions, health requirements, or other conditions on any walk or experience at any time.


5. PAYMENT

5.1 Unless stated otherwise on the checkout or booking page, no payment is required at the time a booking request is submitted.

5.2 Upon confirmation of a booking, Planetwonk will send payment instructions to the Participant.

5.3 Planetwonk may accept payment by credit or debit card, bank transfer, cash, or other methods as communicated at the time of confirmation.

5.4 Payment must be received by the deadline communicated by Planetwonk. Failure to pay by the stated deadline may result in the booking being cancelled.


6. PRICES

6.1 All prices are denominated in Euros (EUR). Where a price is also displayed in U.S. Dollars (USD), the USD figure is indicative only and subject to variation based on exchange rates. The Euro price is the binding price in all cases.

6.2 The price applicable to a booking is the price confirmed in the booking confirmation sent to the Participant, not necessarily the price displayed on the website at the time of the booking request.

6.3 Planetwonk reserves the right to correct typographical or pricing errors and to update prices at any time prior to booking confirmation. If a pricing error is discovered after confirmation, Planetwonk will notify the Participant and offer the option to proceed at the correct price or cancel with a full refund.


7. CANCELLATIONS AND REFUNDS

7.1 Cancellations, refunds, rescheduling, and related conditions are governed exclusively by the Cancellations and Refunds Policy published on theplanetwonk.com, which is incorporated into and forms part of these Terms.

7.2 By booking, the Participant agrees to the Cancellations and Refunds Policy as it exists at the time of booking confirmation.


8. PARTICIPATION, ELIGIBILITY, AND AGE

8.1 Participation in any walk or experience offered through theplanetwonk.com is entirely voluntary.

8.2 Participants must be 18 years of age or older to book and participate independently. Participants under the age of 18 may only join a walk or experience if accompanied throughout by a parent or legal guardian who has accepted these Terms on their behalf.

8.3 By booking, the Participant confirms that they meet the age requirement or that an accompanying parent or guardian has accepted these Terms.

8.4 By joining a walk or experience, the Participant accepts full and personal responsibility for their own decisions, conduct, health, physical condition, and wellbeing.

8.5 The Participant is solely responsible for determining whether a particular walk or experience is appropriate for them given their personal circumstances, health, fitness, and any other relevant considerations.


9. ASSUMPTION OF RISK

9.1 Walks and experiences offered through theplanetwonk.com take place in public spaces, streets, neighbourhoods, and outdoor environments across different countries. Participation involves inherent risks which cannot be entirely eliminated.

9.2 By booking and participating, the Participant expressly acknowledges and voluntarily assumes all inherent risks associated with the walk or experience, including but not limited to:

(a) Physical risks: uneven terrain, steps, slopes, cobblestones, obstacles, traffic, cycling infrastructure, weather conditions including heat, cold, rain, and wind, physical exertion, and fatigue;

(b) Environmental risks: crowded public spaces, noise, air quality, construction, and unpredictable urban conditions;

(c) Political and social risks: exposure to protests, demonstrations, political events, social tension, areas of conflict or unrest, and politically or socially sensitive environments;

(d) Third-party risks: the behaviour of members of the public, local authorities, law enforcement, other participants, or any other third party;

(e) Local condition risks: varying legal frameworks, political climates, safety standards, medical infrastructure, and emergency response capabilities in the countries where walks take place;

(f) Incidental risks: acts of crime, theft, harassment, or other unforeseen incidents in public spaces.

9.3 This assumption of risk is a material condition of the booking. The Participant would not be permitted to participate without accepting it.


10. HEALTH, FITNESS, AND MEDICAL CONDITIONS

10.1 The Participant must not join any walk or experience if they have a physical condition, mental health condition, disability, illness, injury, or any other medical circumstance that makes participation unsafe or inadvisable.

10.2 It is the Participant’s sole responsibility to seek independent medical advice if they are uncertain whether a particular walk or experience is suitable for their condition.

10.3 The Participant must disclose in advance, via the booking form or by direct communication with Planetwonk, any condition that may affect their participation or require accommodation.

10.4 Planetwonk and/or the Host reserve the right to refuse participation or to remove a Participant from a walk or experience at any time if, in their reasonable judgment, the Participant’s health or physical condition poses a risk to themselves or to others.


11. PARTICIPANT CONDUCT AND REMOVAL

11.1 Participants must behave lawfully, respectfully, and considerately at all times toward Hosts, other participants, members of the public, and any venue, property, or location visited during the walk or experience.

11.2 Participants must follow all reasonable safety and operational instructions given by the Host at all times.

11.3 Participants must comply with all applicable local laws, regulations, and ordinances in the country and city where the walk or experience takes place.

11.4 Planetwonk and/or the Host reserve the right to refuse admission to, or remove from a walk or experience, any Participant who:

(a) behaves in a manner that is abusive, threatening, violent, or discriminatory;
(b) behaves in a manner that endangers the safety of themselves or others;
(c) is under the influence of alcohol or controlled substances;
(d) engages in conduct that is disruptive, offensive, or likely to cause distress to others;
(e) fails to follow reasonable instructions given by the Host; or
(f) behaves in any manner that, in Planetwonk’s or the Host’s reasonable judgment, is incompatible with the safe and proper conduct of the walk or experience.

11.5 Removal under clause 11.4 does not entitle the Participant to a refund except to the extent required by the applicable Cancellations and Refunds Policy.


12. LIMITATION OF LIABILITY

12.1 To the fullest extent permitted by applicable law, Planetwonk LLC, its members, officers, employees, agents, and contractors (including Hosts) shall not be liable to any Participant or third party for:

(a) death or personal injury howsoever caused, except to the extent caused directly by Planetwonk’s own gross negligence or wilful misconduct;
(b) illness, psychological harm, or emotional distress arising from participation;
(c) theft, loss, damage, or destruction of personal property before, during, or after a walk or experience;
(d) any indirect, consequential, special, incidental, or punitive loss or damage of any kind;
(e) loss of enjoyment, disappointment, distress, or loss of amenity;
(f) any loss or expense arising from cancellation, rescheduling, delay, interruption, shortening, or modification of a walk or experience;
(g) any loss or damage arising from the political, social, environmental, or legal conditions of any location visited;
(h) any act, omission, negligence, misconduct, or breach of duty by any Host, third-party provider, member of the public, local authority, or other person not under the direct control of Planetwonk.

12.2 Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable mandatory law, including the mandatory consumer protection laws of the country in which the Participant is habitually resident.

12.3 Where liability cannot lawfully be excluded or limited, Planetwonk’s maximum total liability to the Participant for any and all claims arising from a single booking shall not exceed the total amount paid by the Participant for that specific booking.

12.4 The Participant agrees that the limitations and exclusions of liability set out in these Terms are reasonable and reflect the voluntary nature of participation, the inherent risks acknowledged under clause 9, and the price charged for the walk or experience.


13. INDEMNIFICATION

13.1 The Participant agrees to indemnify, defend, and hold harmless Planetwonk LLC, its members, officers, employees, agents, contractors, and Hosts from and against any and all claims, demands, actions, losses, liabilities, costs, expenses (including reasonable legal fees), and damages arising out of or related to:

(a) the Participant’s breach of these Terms;
(b) the Participant’s negligence, wilful misconduct, or unlawful conduct during or in connection with a walk or experience;
(c) any injury caused by the Participant to another participant, a Host, or a third party;
(d) any damage caused by the Participant to property belonging to a third party.


14. PERSONAL RESPONSIBILITY

14.1 Each Participant remains fully and personally responsible for their own choices, movements, conduct, safety, and wellbeing at all times before, during, and after any walk or experience.

14.2 Planetwonk does not provide supervision, safety equipment, first aid, insurance coverage, or emergency assistance as part of any walk or experience. Participants are responsible for their own emergency preparedness.

14.3 Participants are responsible for reading all pre-booking information, pre-walk briefings, and any other communications provided by Planetwonk or the Host.

14.4 Participants are responsible for arriving at the correct location on time. Planetwonk and Hosts are under no obligation to wait for late arrivals or to offer refunds for missed walks due to late arrival.


15. CHANGES, CANCELLATIONS, AND EXTRAORDINARY CIRCUMSTANCES

15.1 Planetwonk and/or the Host reserve the right to change routes, meeting points, timing, duration, content, format, or other elements of any walk or experience at any time when reasonably necessary.

15.2 Planetwonk reserves the right to cancel or reschedule any walk or experience for any reason, including circumstances beyond its reasonable control.

15.3 “Extraordinary Circumstances” means events or conditions beyond Planetwonk’s reasonable control that make it impossible, unsafe, or impractical to deliver a walk or experience as planned, including but not limited to: natural disasters, extreme weather, pandemics, epidemic outbreaks, government action, official travel advisories, civil unrest, protests, riots, military action, strikes, industrial action, power failures, venue closures, or infrastructure failures.

15.4 Planetwonk shall not be liable for any loss, cost, or damage resulting from changes, cancellations, or interruptions caused by Extraordinary Circumstances, subject to any rights that cannot lawfully be excluded under applicable mandatory law.


16. WEBSITE USE AND INTELLECTUAL PROPERTY

16.1 All content on theplanetwonk.com, including but not limited to text, walk descriptions, itineraries, branding, logos, layout, images, and audiovisual content, is the exclusive property of Planetwonk LLC or is used with the permission of the rights holder, and is protected by applicable copyright and intellectual property law.

16.2 The Participant may not copy, reproduce, republish, redistribute, sell, sublicense, or commercially exploit any content from theplanetwonk.com without the prior written consent of Planetwonk.

16.3 Planetwonk reserves the right to update, modify, suspend, or remove any part of the website, or any listed walk or experience, at any time and without notice.


17. PRIVACY AND DATA PROTECTION

17.1 Personal data submitted through theplanetwonk.com is processed by Planetwonk LLC in accordance with the Privacy Policy published on theplanetwonk.com, which forms part of these Terms.

17.2 By submitting a booking request, the Participant confirms that they have read the Privacy Policy and understands how their personal data will be processed.


18. GOVERNING LAW

18.1 These Terms, and any contractual or non-contractual dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and interpreted in accordance with the laws of the State of Wyoming, United States of America.

18.2 The Participant acknowledges that, where mandatory consumer protection laws of the country in which the Participant is habitually resident cannot be excluded or derogated from by contractual choice of law, such mandatory provisions shall apply in addition to Wyoming law and to the extent required by those mandatory provisions.


19. DISPUTES

19.1 In the event of any dispute, complaint, or claim arising out of or in connection with these Terms or any booking, the Participant must first contact Planetwonk directly using the contact details in clause 23 and allow Planetwonk a reasonable opportunity to resolve the matter.

19.2 Planetwonk will endeavour to respond to all complaints within 14 calendar days of receipt.


20. SEVERABILITY

20.1 If any provision of these Terms is found by a court or competent authority to be invalid, unenforceable, or unlawful under applicable law, that provision shall be severed from the rest of these Terms, which shall remain in full force and effect.

20.2 The parties agree that in the event of severance, the remaining provisions shall be interpreted so as to give effect to the original intent of the parties as closely as possible.


21. ENTIRE AGREEMENT

21.1 These Terms, together with the Cancellations and Refunds Policy and the Privacy Policy published on theplanetwonk.com, constitute the entire agreement between Planetwonk and the Participant in relation to any booking.

21.2 These Terms supersede and replace any prior written or oral representations, warranties, or agreements between Planetwonk and the Participant in relation to the subject matter hereof.


22. CHANGES TO THESE TERMS

22.1 Planetwonk reserves the right to update or amend these Terms at any time. Updated Terms will be published on theplanetwonk.com with a revised effective date.

22.2 The version of these Terms in force at the time of booking confirmation shall govern that booking, unless applicable mandatory law requires otherwise.
